KIE: Defective newborns are considered persons, thereby establishing actions in their best interest as a primary duty in proxy consent. This duty, in restricted circumstances, may override the infant's right to life. Integration of social and familial utilitarian considerations with a refinement of Richard McCormick's "relational potential" idea of quality of life provides criteria for the ethical evaluation of spina bifida infants. Treatment vs. nontreatment decisions paralleling those for ordinary vs. extraordinary treatment may then be made.
